These Terms and Conditions, along with the Agreement, are governed and interpreted according to the laws of England and Wales. By utilising "Pendant Alert Ltd" (company reg: 15530779), "you" (the User) agree to be bound by these Terms and Conditions. The GPS Smart Tracker SOS Pendant is referred to as the "SOS Pendant" herein. Please note, all communications with the Monitoring Centre are recorded for quality and resolution purposes.

Service Provision

• The Monitoring Centre operates 24/7, every day of the year, to respond to calls from the SOS Pendant, provided the User complies with these Terms and Conditions.

• In case of a dispute arising from this Agreement, the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

• Pendant Alert Ltd ensures a response rate of 99.99% to alarm activations within 60 seconds, including test calls. Alternate arrangements will be made promptly in the rare event of a Monitoring Centre outage.

• Upon receiving an assistance call, the Monitoring Centre may contact emergency services, a doctor, or a designated contact, depending on the situation's requirements.

• It is the User's responsibility to provide accurate information upon service registration. Inaccurate information may result in service suspension or termination.

• The SOS Pendant is designed for emergency assistance. Users are reminded that while it aims to reduce the risks associated with independent living, it cannot eliminate them entirely. Regular testing of the alarm is recommended.

• Users are responsible for all activities on their account. Any suspected security breaches with the SOS Pendant must be reported to Pendant Alert Ltd immediately.

Payment and Fees

• Users are liable for any charges incurred by Pendant Alert Ltd due to late payments or incorrect banking details. A £10 fee will be applied for each failed payment, in addition to any further administrative costs.

• Pendant Alert Ltd reserves the right to suspend or cancel the service if payments are not made as scheduled.

• Notice of any changes to subscription fees will be given in writing 30 days prior to such changes taking effect.

• VAT exemption applies as per the government tax relief scheme for individuals with disabilities or long-term medical conditions.

Equipment and Usage

• Activation of the SOS Pendant is required upon delivery, facilitated through an introductory call with our Customer Service team.

• The User is responsible for maintaining the battery unit fully charged and testing the SOS Pendant at least once a month.

• For those using the 24-hour Monitoring Service, up-to-date contact details for all nominated contacts/keyholders must be provided.

• Pendant Alert Ltd is not liable for service failures due to user negligence, such as improper use of the SOS Pendant or failure to test it. In cases where service failure is attributable to Pendant Alert Ltd, a replacement SOS Pendant will be provided at no additional cost.

Emergency Access

• Users must provide current contact details for nominated contacts/keyholders to allow emergency access to the property if needed.

Cancellations and Returns

• To cancel the service, contact Pendant Alert Ltd immediately via Freephone or email. The SOS Pendant, along with all its components, must be returned in its original packaging to the specified address.

Equipment Replacement

• All equipment replacements, including the SOS Pendant and its components due to theft, loss, or damage, are provided at no additional cost to the User.

Privacy and Data Protection

• Personal information collected is protected under the Data Protection Act 2018 and GDPR 2018. This information is necessary for providing the service and is kept in strict confidence for privacy assurance. Certain personal and GPS tracking information may be shared with trusted agencies as necessary to deliver the service.
